Common Misnomer - Use of photography on the world-wide-web is the same as using photography in a newsletter, trade publication, or magazine.
 
Photography on a company or association web-site is considered corporate promotion. It is treated, according to counsel, as a corporate brochure, or other printed promotional material, when it comes to the depiction of readily-identifiable individual(s) within the photographs.
 
What does this mean? It means that everyone who is readily-identifiable within a photograph that appears on an association or corporate web-site must have a signed MODEL RELEASE on file. Not getting a model release from individuals who appear in photography which is on a web-site can open a company to LIABILITY.
 

As a part of the standard Public Relations event photographic services we provide, we DO NOT include the use of photography on web-sites, without:

AND
  • B) original signed model releases from those in the photograph(s),
OR
  • C) in some cases, a signed waiver of liability and assumption of risk from our client for any photograph(s) they wish to display on their website of their executives, officers, or employees for whom the client does not have a release and believes they do not need one.
